Could be a violation Article 6 of the ECHR. As in Article 6 of the European Convention on Human Rights — which like the Fifth Amendment of the U.S. Constitution — provides protections to individuals from being forced to incriminate themselves.

The issue needs more debate.
But what happens when you can't refuse? After all, science is getting better at understanding kinesic information leakage (video).
